“JIM BEAM QR CODE ON CAN LIMITED OFFER” PROMOTION
TERMS AND CONDITIONS

  1. Information on how to claim and the rewards form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. The Promoter is Beam Suntory Australia Pty Ltd (ABN 85 003 953 357) of Level 18, 100 Pacific Highway, North Sydney, NSW 2060 (“Promoter”). Telephone: 02 8977 9700.
  3. Claims are only open to Australian residents (excluding NT residents) aged 18 years or over.
  4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. Offer commences 11/08/2025. Claims close 5:00pm AEST on 07/09/2025, or once two hundred (200) valid claims (50 available per week) have been received, whichever is first to occur (“Offer Period”). The Promotional Period will be divided into four (4) claim periods (each a “Claim Period”) as outlined in the table below. Claims for each Claim Period will commence on the dates specified in the table below from the moment the Promoter publishes a post or story to its Facebook and/or Instagram account promoting the offer for that Claim Period. Claims close at 11:59pm AEST on the dates specified in the table below, or once all allocated claims for that Claim Period are received, whichever is first.5. Offer will occur each Monday commencing on 25/08/2025 and closing at 11:59pm AEST on 21/09/2025, or once two hundred (200) valid claims (50 available per week) have been received, whichever is first to occur (“Offer Period”). The Promotional Period will be divided into four (4) claim periods (each a “Claim Period”) as outlined in the table below. Claims for each Claim Period will commence on the dates specified in the table below from the moment the Promoter publishes a post or story to its Facebook and/or Instagram account promoting the offer for that Claim Period. Claims close at 11:59pm AEST on the dates specified in the table below, or once all allocated claims for that Claim Period are received, whichever is first.

  7. To be eligible to claim, individuals must purchase one (1) specially marked can of Jim Beam 375ml (Excludes Jim Beam Black Double Serve) (“Eligible Product”) from any participating store. A participating store is any liquor store nationally that stocks Eligible Products during the Offer Period.
  8. To claim, individuals must then complete the following steps during the Offer Period:
    • Visit the Promoter’s Facebook and/or Instagram account for the particular week and once the Claim Period commences, scan the QR code on their Eligible Product to access the Claim page to enter;
    • Verify they are 18 years or over;
    • Enter their mobile phone number to receive a unique 4 digit verification code sent to their mobile phone;
    • Enter the unique 4 digit verification code on the website when prompted;
    • Tap the claim button when prompted;
    • Input the requested details (full name, date of birth, nominated delivery address, email address, phone number); and then
    • Submit the fully completed claim form.
  9. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including an claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  10. Incomplete or returned orders will be deemed invalid.
  11. Only one (1) claim is permitted per person.
  12. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
  13. The first fifty (50) claims received in each Claim Period will each be awarded a 6-pack of the new Jim Beam Vanilla Cola valued at AU$36.00. Successful claimants will be notified by email and will have their reward delivered to their nominated address and will be required to present proof of age upon signing for the delivery.
  14. In the event not all fifty (50) rewards are awarded in a particular Claim Period, any leftover rewards will be carried over into subsequent Claim Periods. If at the end of Claim Period 4, not all two hundred (200) rewards are awarded any leftover rewards will be awarded in an additional Claim Period. The additional Claim Period will open for purchases and claims from 22/09/2025 and close at 11:59pm AEST on 28/09/2025, or once all leftover rewards are claimed, whichever is first to occur. Any left over rewards from this additional Claim Period will not be awarded.
  15. Incomplete or indecipherable claims will be deemed invalid.
  16. If a claimant is requested to verify the validity of their claim via SMS or email, they must respond within five (5) business days.
  17. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  18. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
  19. The Promoter’s decision is final and no correspondence will be entered into.
  20. The Promoter will not be responsible for rewards to be re-sent to winners, in the event that the winner provides incorrect mailing details to the Promoter, winners are not home to take delivery (if required), or rewards are ‘returned to sender’.
  21. If for any reason a winner does not take a reward at the time stipulated by the Promoter, then the reward will be forfeited.
  22. Rewards are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  23. If any reward is unavailable, the Promoter, in its discretion, reserves the right to substitute the reward with a reward to the equal value and/or specification.
  24. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Claim and continued participation in this promotion is subject to the licensee’s liquor serving policy.
  25. Claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner of the reward (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  26. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  27. Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the Internet service provider used.
  28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or reward claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or claimant; or (f) use/taking of a reward.
  30. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and reward suppliers. Claim is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed here. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All claims become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (see the Promoter’s Privacy Policy for details).
